Abstract
This literature review was undertaken by Dr Pearse McCusker and myself for submission to the Scottish Mental Health Law Review (SMHLR) . The motivation for this was that the SMHRL was considering whether to rescind this Act and return adult safeguarding powers to mental health and mental capacity legislation. It reviewed the published evidence to critically consider the extent to which it was compliant with the UN Convention of Rights for Persons with Disabilities (CRPD). It was unfunded research and we requested they did not publish it as we have since submitted an invited book chapter and journal article.
