Abstract
The First Minister has asked the Advisory Group on Human Rights Leadership to recommend the next steps on Scotland’s human rights journey, including finding a way forward in the context of post-Brexit uncertainty. This includes how to give effect to three guiding principles: • non-regression from the rights currently guaranteed by membership of the European Union; • keeping pace with future rights developments within the European Union; and • continuing to demonstrate leadership in human rights. These recommendations are to apply across the potential post-Brexit scenarios of current devolution, further devolution and of independence. It is not part of the mandate to advocate for any particular constitutional outcome. The Advisory Group was asked to make recommendations encompassing the full range of human rights which include civil, political, economic, social and cultural as well as environmental rights. In addition, the Advisory Group was to consider if and how to incorporate rights from the United Nations treaties into Scottish law and governance.
